Rafiki Expressions

Welcome to Rafiki Expressions. By booking, purchasing, collaborating with, hiring, communicating with, or otherwise engaging Rafiki Expressions for photography, videography, creative direction, graphic design, branding, social media management, consulting, or event coverage services, you acknowledge and agree to the following Terms & Conditions.

These terms exist to protect the creative integrity, business operations, intellectual property, reputation, time, equipment, artistic vision, and professional value of Rafiki Expressions and its owner.

Failure to read these policies does not waive your agreement or responsibility.

1. Ownership of Creative Work & Intellectual Property

ALL content created by Rafiki Expressions remains the exclusive intellectual property of Rafiki Expressions unless otherwise agreed to in writing.

This includes but is not limited to:

  • Photographs

  • RAW files

  • Edited images

  • Video footage

  • Reels

  • Graphic designs

  • Logos

  • Branding concepts

  • Marketing campaigns

  • Captions

  • Ad copy

  • Mood boards

  • Creative direction

  • Shot lists

  • Lighting setups

  • Posing concepts

  • Social media strategies

  • Website visuals

  • Promotional materials

  • Templates

  • Presets

  • Retouching styles

  • AI-assisted creative concepts

  • Behind-the-scenes content

  • Course or educational material

Clients may not:

  • Alter, heavily edit, filter, recolor, crop, distort, or manipulate delivered work without written permission

  • Claim Rafiki Expressions work as their own

  • Remove watermarks or credits

  • Resell or redistribute content

  • Submit work into contests, magazines, or publications without written approval

  • Send images to other editors for modification

  • Use work for AI training, NFTs, datasets, stock platforms, or commercial resale

  • Recreate Rafiki Expressions concepts, campaigns, poses, branding, or signature visual style for competing businesses

Rafiki Expressions reserves the right to pursue legal action for copyright infringement, unauthorized usage, defamation, intellectual property theft, unauthorized editing, misuse of likeness, or commercial exploitation.

2. Artistic & Creative Control

By hiring Rafiki Expressions, clients acknowledge and agree that:

  • Creative direction remains solely with Rafiki Expressions

  • Editing style, lighting choices, color grading, composition, retouching level, framing, cropping, and overall artistic interpretation are determined exclusively by Rafiki Expressions

  • Clients are hiring the brand specifically for its artistic identity and signature style

Rafiki Expressions is not obligated to replicate:

  • Pinterest inspiration

  • TikTok trends

  • Competitor aesthetics

  • Other photographers’ edits

  • Viral poses

  • AI-generated concepts

  • Unrealistic body modifications

Requests that compromise artistic quality, brand standards, ethics, professionalism, or creative integrity may be declined without explanation.

3. Booking Policy

A signed agreement and non-refundable retainer are required to secure all bookings.

No dates, events, sessions, consultations, travel arrangements, editing schedules, or creative services are reserved until payment is received.

Bookings are first come, first served.

Rafiki Expressions reserves the right to refuse service to any individual, organization, business, or event for any reason deemed appropriate.

4. Payments, Retainers & Chargebacks

All retainers, deposits, booking fees, consultation fees, rush fees, and creative planning fees are:

  • Non-refundable

  • Non-transferable

  • Non-negotiable

Failure to pay invoices by the due date may result in:

  • Cancellation of services

  • Delayed delivery

  • Watermarked previews only

  • Refusal of future bookings

  • Legal collection action

Chargebacks or fraudulent disputes after services are rendered or content is delivered will be aggressively disputed with:

  • Signed agreements

  • Message history

  • Email records

  • Delivery timestamps

  • GPS/location metadata

  • Screenshot evidence

  • Camera metadata

  • Preview galleries

  • Social proof

  • Witness documentation

Clients initiating bad-faith disputes may be permanently blacklisted from future services.

5. No Refund Policy

Due to the creative, customized, time-based, and artistic nature of all services:

ALL SALES ARE FINAL.

No refunds shall be issued for:

  • Personal preference disagreements

  • Dissatisfaction based on subjective opinion

  • Appearance insecurities

  • Outfit choices

  • Makeup issues

  • Hair issues

  • Weight fluctuations

  • Posing discomfort

  • Failure to follow instructions

  • Late arrivals

  • Missed moments caused by client or venue restrictions

  • Weather conditions

  • Venue lighting limitations

  • Social media algorithm performance

  • Business outcomes

  • Viral expectations not being met

Creative work is subjective and final delivery reflects the professional judgment of Rafiki Expressions.

6. RAW Files & Unedited Content

RAW files, unedited footage, unfinished edits, project files, layered files, Lightroom catalogs, Photoshop working files, and behind-the-scenes production assets are NEVER included unless specifically purchased and contractually agreed upon.

Rafiki Expressions reserves the right to deny RAW file requests at its sole discretion.

Ownership of RAW files does not transfer copyright ownership.

7. Social Media Management Policies

Clients hiring Rafiki Expressions for social media management, branding, content strategy, ad creation, or campaign management acknowledge that:

  • Results are not guaranteed

  • Growth metrics fluctuate

  • Viral performance cannot be promised

  • Platform algorithms are outside company control

Rafiki Expressions is not liable for:

  • Decreased engagement

  • Account restrictions

  • Shadow bans

  • Platform outages

  • Loss of followers

  • Third-party app issues

  • Ad account problems

  • Copyright strikes caused by client-provided assets

  • Business losses

  • Reputation disputes caused by client behavior

Clients remain fully responsible for:

  • Their own business decisions

  • Legal compliance

  • Music licensing

  • Trademark usage

  • Advertising claims

  • Public communication

  • Account security

Failure to provide timely approvals, assets, passwords, or communication may delay content schedules without liability to Rafiki Expressions.

8. Event Coverage Policies

Rafiki Expressions is not responsible for missed coverage caused by:

  • Venue restrictions

  • Poor lighting

  • Delayed schedules

  • Disorganized coordinators

  • Guest interference

  • Security limitations

  • Weather

  • Equipment obstruction

  • Client lateness

  • Lack of cooperation

  • Unsafe environments

The client understands that:

  • No specific image, guest, moment, pose, or reaction is guaranteed

  • Photography and videography coverage are dynamic live-event services

  • Artistic judgment determines what is captured and delivered

Rafiki Expressions reserves the right to stop shooting immediately if:

  • Conditions become unsafe

  • Harassment occurs

  • Physical threats occur

  • Equipment is endangered

  • Disrespectful treatment occurs

  • Illegal activity is present

  • Contract terms are violated

No refunds will be issued under such circumstances.

9. Delivery Timelines

All turnaround times are estimates only and may change due to:

  • Workload

  • Travel

  • Emergencies

  • Illness

  • Equipment issues

  • Creative workload

  • Peak seasons

  • Client delays

  • Revision requests

Repeated requests for updates, excessive messaging, harassment regarding delivery, or unreasonable pressure tactics may result in delayed communication or termination of the working relationship.

10. Revision Limits

Rafiki Expressions reserves the right to limit revisions.

Excessive revision requests, contradictory instructions, unrealistic demands, or repeated dissatisfaction after approvals may incur additional fees.

Creative direction changes after project approval may require project restarting fees.

11. Client Conduct Policy

Respectful and professional behavior is required at all times.

Rafiki Expressions reserves the right to terminate services immediately without refund for:

  • Harassment

  • Aggressive behavior

  • Manipulation

  • Defamation

  • Disrespect

  • Threats

  • Racism

  • Sexual misconduct

  • Boundary violations

  • Excessive entitlement

  • Public slander

  • Intoxicated interference during shoots

12. Equipment & Liability Protection

Clients are financially responsible for any damage caused directly or indirectly to Rafiki Expressions equipment due to:

  • Negligence

  • Guest interference

  • Unsafe environments

  • Water exposure

  • Physical mishandling

  • Unauthorized touching of equipment

This includes cameras, lenses, lighting, drones, memory cards, computers, monitors, stabilizers, audio equipment, and accessories.

13. Commercial Usage & Licensing

Personal-use sessions do not automatically include commercial usage rights.

Businesses, brands, organizations, publications, artists, influencers, agencies, political campaigns, and corporations must obtain written commercial licensing approval before using content for:

  • Advertising

  • Paid promotions

  • Billboards

  • Merchandise

  • Packaging

  • Sponsorships

  • Media campaigns

  • Magazine publication

  • Album covers

  • Business resale purposes

Unauthorized commercial usage may result in retroactive licensing fees and legal action.

14. Travel & Location Policies

Travel fees may apply outside standard service areas.

Clients are responsible for:

  • Required permits

  • Venue permissions

  • Parking fees

  • Access fees

  • Security clearances

  • Location compliance

Rafiki Expressions reserves the right to refuse unsafe, illegal, dangerous, or unethical shooting environments.

15. Website, Branding & Graphic Design Policies

All drafts, concepts, mockups, unfinished work, and creative strategies remain the property of Rafiki Expressions unless fully paid for and released in writing.

Clients may not:

  • Present drafts to other designers

  • Request imitation of protected concepts

  • Use unpaid concepts commercially

  • Extract design elements from previews

Unused concepts remain the sole property of Rafiki Expressions.

16. Reputation & Public Disparagement

Clients agree not to publicly defame, misrepresent, falsely review, maliciously post about, or intentionally damage the reputation of Rafiki Expressions or its owner.

Rafiki Expressions reserves the right to pursue legal remedies for:

  • False claims

  • Defamation

  • Slander

  • Edited-context harassment

  • Misleading reviews

  • Intentional reputation sabotage

17. Force Majeure

Rafiki Expressions shall not be held liable for failure or delays caused by:

  • Natural disasters

  • Government restrictions

  • Civil unrest

  • Pandemics

  • Transportation failures

  • Emergencies

  • Power outages

  • Venue shutdowns

  • Acts beyond reasonable control

18. Limitation of Liability

Rafiki Expressions shall never be liable for:

  • Emotional distress claims

  • Indirect damages

  • Lost profits

  • Missed business opportunities

  • Social media performance

  • Platform algorithm changes

  • Event disruptions

  • Third-party actions

  • Data loss

  • Incidental damages

Maximum liability shall never exceed the total amount paid directly to Rafiki Expressions for the affected service.

19. Agreement to Terms

By booking, paying, communicating business intent, signing agreements, attending sessions, participating in events, downloading deliverables, or using this website, you acknowledge that you:

  • Have read these Terms & Conditions

  • Fully understand them

  • Voluntarily agree to them

  • Accept all policies stated herein

No verbal agreement, social media message, or informal conversation overrides these written Terms & Conditions unless expressly stated in writing and signed by Rafiki Expressions.
